It is legally troublesome. The poz top could be held criminally liable, in which case he will likely be charged with reckless endangerment (though NY judges have been very creative with this, as it is more of a common law doctrine–not one that is grounded in the New York Penal Law). You claim that the law gets murky where the bottom consented to bb. This is not true. I have a friend who had a top lie to him about his status, consented to bb on a casual sexual encounter, and then found out the guy was poz. My friend then proceeded to press charges against the top, and that top faced very serious criminal punishment. Under criminal law, it’s not even necessary for the bottom to test positive– as long as he was put at risk for transmission, then the bottom has a cause of action.
Even if not actionable under criminal law, there would be a very strong cause of action for a tort– arguably either negligence on the part of top, intentional/negligent infliction of emotional distress, etc. The top, knowing of his HIV status, has a tortious duty to disclose his status to his sexual partner. Failure to do so and to engage in risky sexual behavior constitutes a breach of that duty. Arguably, there would be contributory liability for the bttm if he consented, but in a state like NY, the bttm can still recover for portions of the damages anyway (this could include medical expenses, etc).
What I’m getting at is while this may be a turn on for the top, he better think twice about doing so. He could either face pretty serious criminal charges. If not criminal charges, the bottom could sue for damages and will likely win. As you allude to, there are very serious legal problems– but they’re even more serious and dire than you think.
